CPM Wants to Bring Impeachment Motion Against CJI Dipak Misra in Budget Session
New Delhi, Jan 23: Communist Party of India (Marxist) or CPM general secretary Sitaram Yechury on Tuesday said his party is contemplating to bring an impeachment motion against Chief Justice of India Dipak Misra in Budget Session of Parliament. Yechuri said the CPM is discussing the possibility of an impeachment motion with opposition parties.
“(It) looks like the crisis is not resolved yet so need to intervene and its time to play the role of the executive,” Sitaram Yechury told news agency ANI. “We are discussing with opposition parties on the possibility of an impeachment motion against CJI in Budget session,” the CPM leader added. The Budget Session of the Parliament will start on January 29.
“There is only one option left. It is the responsibility of the legislature with the executive to correct this institution (judiciary) if there is anything wrong,” Yechury was further quoted as saying by a news channel.
In an unprecedented press conference earlier this month, four senior-most judges of Supreme Court – Justices J Chelameswar, Ranjan Gogoi, M B Lokur and Kurian Joseph – said that “things are not in order” at the Supreme Court. One of the key points raised by the four judges was the “selective” allocation of cases by the CJI.
The judges released an undated letter they wrote to Justice Misra in which they conceded that the Chief Justice was the master of roster but this was “not a recognition of any superior authority, legal or factual of the Chief Justice over his colleagues”. Asked if they were seeking impeachment of the CJI, Justice Chelameswar said: “We are not saying anything. Let the nation decide.”
