Relief for Chidambaram: Trial court rejects Subramanian Swamy's plea

A trial court rejected Janata Party chief Subramanian Swamy's plea to make union Home Minister P. Chidambaram a co-accused in the 2G spectrum allotment case.

Speaking to the media after the verdict, Swamy said, "This order deserves to be reversed". He clearly stated that he will approach the High court, if it still goes against him, he will appeal to the Supreme court. He also said he had a strong case against Chidambaram and A Raja, that they made the decisions together.

Upon being asked if he was disappointed with the verdict, he said there was no question of disappointment. However, he did say he was surprised at the judgement because he said his evidence was complete.

As soon as the verdict was pronounced, the BJP and Congress began their slugfest. BJP said they want political accountability and that Chidambaram's role in the 2G scam is apparent. Spokesperson Ravi Shankar Prasad said, " We can not lose sight of the fact that SC has quashed 122 licenses".

Meanwhile senior Congress leader Kapil Sibal the Congress party stands vindicated. Ambika Soni said Swamy is doing this to get attention and that this is a victory of the truth.

Only the petitioner, Subramanian Swamy is allowed to inside the courtroom. Swamy is accompanied by his wife and private secretary. Meanwhile reports say that Chidambaram is scheduled to fly out of Delhi at 1pm.

Swamy had filed a plea seeking direction to the Central Bureau of Investigation (CBI) to probe the role of Chidambaram in fixing 2G licence prices and grant of spectrum. In his application, he had said under the 2003 decision of the empowered Group of Ministers (GoM) approved by the cabinet, the pricing formula for spectrum was required to be finalised jointly by the department of telecommunications (DoT) and the finance ministry headed by P. Chidambaram at that time.

I feel its only a temporary respite for PC. Just as Raja was ultimately hauled up, law will catch up with him as well.

Kapil Sibal, the most perverted and crooked minded minister in this UPA cabinet said that "now Swbramaniam Swamy can only appeal to God". No one, but himself knows as to whether this was said as a sarcastic comment or not. If Sibal is another athest like Chidambaram, let him understand that, Subramaniam Swamy will not appeal to God, but will pray to god to punish first crooks like Sibal and then intellectual frauds like Chidambaram. It did not require a rocket scientist to know the verdict already. CBI is under the control of Home Ministry. Head of the Home Ministry is Home Minister. Home Minister is Chidambaram. So how can the CBI special court indict its master?. In the 413 coments hereunder, not a single one support either Chidambaram or the UPA regime. These comments are the voice of this nation. This force is potential. This will be converted into kinetic force during coming 2014 election.

Why the judge took so much time to reject the petition First they said the judgment will be delivered at 10.15 and then at 12.15 and finally around 2.00pm. Fail to understand whether there was any interference or influence.

why not Shri Swami pursue the election case of Chidhambaram which is yet to be taken up? He can definitely win over there since Chidambaram's victory was a bogus one - When the courts are going to take up his election case - is it only after he completes his five year term?

even if chidambaram's culpability is not proved in courts, everybody knows he is a crook. raja never had the brains to carry out this thievery all by himself. there were other people involved in the loot. Am sure Dr.Swamy will not rest, if anything this will increase his resolve to appeal & strengthen the case against the HM

Foot Digvijay. Why BJP shpuld apologise to Corrupt Chidambaram. CBI is under the armpit of Congress Goverment so they could twist the verdict to their favour. Thats why BJP demand CBI should be an independant body like Election Commission in the RS Debate during Lokpal Bill. CBI Courts vrdict is nothing. Why Congress celebrate? there are two more upper courts High Court & Supreme Court. Hope Chidambarm get convicted in the High Court.
Jaihind & Jai Corruption Crusader Mr.Subramaniam Swamy.
Indian Publics should fund Mr.Subramaniam Swamy for his fight against the Corrupt.

Mr.Santhosh, In a court of law, things goes by merits. No popularity or any influence does not matter. The lower court judges are very careful that always one judgment mostly goes for appeal. Raja was only an arrow, the bows will be never may be implicated or suffer the heat because the bows have not directly and never involve. In a court of law one has to prove the allegations. In corruption cases it not that easy. In Raja's case the procedures of the government are violated which are direct evidences.

The government had already told the court that Neera Radia tapes are doctored means they are fake. The courts do not take tapes, polygraph tests etc etc as evidence. They are the investigating tools only. In the world politicians are more powerful by their position forget that the constitution has given them that much power or not. But we people are more powerful than anybody by having a tool to vote. But one party goes and the other comes. What changes you will expect. only the regime change.

The trial court in it's wisdom has dismissed the petition , albeit this may not be the end of it, but in this tug-of-war the verdict setting a time-frame to issue sanction to prosecute the allegedly corrupt may go a long way in fighting against corruption by not dragging the process endlessly & the upsides of this may be more than the downsides going forward.
