    SC asks government for action taken report on ex-CJI Balakrishnan property case

    New Delhi, Feb 13 (ANI): Supreme Court today asked the Centre to brief it on action taken on an allegation against former Chief Justice of India and NHRC chairman K G Balakrishnan for amassing disproportionate assets.

    A bench headed by Chief Justice S H Kapadia directed the government to respond within a month on action taken by it or intended to be taken regarding the allegation.

    The bench asked Attorney General G E Vahanvati to appraise it on the issue within a month.

    Vahanvati, in response, assured the court that he will go through the petition and will write to all government authorities concerned.

    The court was hearing a PIL filed by NGO Common Cause seeking directions to the government to conduct probe against the former CJI for allegedly amassing disproportionate assets.

    KG Balakrishnan, who had disclosed his assets and liabilities for 2009 and 2010, did not provide information for 2007 and 2008 when held the post of Chief Justice of India.

    Balakrishnan, who heads the National Human Rights Commission, had informed the Income Tax Department in April last year that he was not willing to disclose his assets as they were not related to any public interest. (ANI)

      OK let balakrishananji will disclose the particulars years details, how many of the indian rich ready to disclose their existing wealth and its root. In india, if you are rich mean you must have the history of cheating poor or compromised with govts including british , mughals. Nothing of their fa or ma sweated to amass the wealth! all having illegal roots. I don't know why these people who could reach media also who mostly of upper caste beating their drum this much ugly, only in the case of scs,, curse of india??

      Chief Justice Kapadia deserves a Super Bharat Ratna. It is because of him that judges are taking bold decisions, and not being soft on government and politicians. That is why corrupt netas are being taken to task in cases like 2G.

      What govt ? what action ? The govt itself is in-active ! There is utter disregard for law by this govt, which is slowly but steadily percolating down the citizenry and taking roots. The PM nor his govt does not instill any confidence, reassurance or positiveness to the people of this country. Today's bomb blast right in front of the PMs residence speaks volumes about the deterioration.

      Why blame all politicians/IAS/IPS/Judges etc being corrupt. Why cannot you be one of them and enjoy the status. Because, that is a more possible option than trying to change the systems? Even all Gods put together (Hindu's/Christian's/Muslim's) will not make a dent.       This criminal Balakrishnan was not fit to be promoted to Kerala HC, as he did not have required experience. This is another example of everything is possible in Kerala including courts. E-mail bail to convicted terrorists like Sanjay Dutt and Memon relations is the murder of judicial system. Have you ever heard of anything from e-mail in any court from top to bottom before and after? If more than 60000 cases are in SC and more than 30 million in different courts, blame yourself for tolerating these criminals with some of the filthiest and dirtiest mindsets!!!!

      It is just for public consumption, every day we read in the papers about scams, blackmoney,etc. but till today has any politician, IAS IPS and any other high ranking officer has been covicted or punished ? It is suggested and expected their property be confiscated and all kind of facilities be withdrawn but who will do that ? When likes of Kalmadi, R P SHARMA (IPS) can come out of jails, day is not far when RAJA will also come out they are just bying time.

      we can get better judgement's if only retired judges are not given government jobs after retirement. eg; in enquiry commission etc., There are so many young law graduates
      waiting for jobs. They can be entrusted with jobs and their performance will be watched by
      the nation. comments on their performance should be welcomed instead of strangulating

      When the court is so serious to know about the action taken by the government on shri k.g.balakrishnan, why the same court keeping silent regarding extra ordinary delay in taking up the election case of shri p.chidambaram. how come the learned judges of the courts in india are allowing shri p.chidambaram to function as cabinet level minister, without declaring whether shri p.chidambaram's election result is genuine and free from fraud or rigged and fraud. How come p.chidambaram all the times gets concessions from hon.court. The hon. Court need to take immediate action in this matter, other wise the entire judiciary will be painted with black by the historians. jai hind.

      Depending on whims, the Indian Hon. courts can decline to accept the universally accepted high-school certificate or decline to accept the contender's mere written statement . A recent case example manifests glorifies and testifies this aspect when the Hon’ble UttraKhand High Court at Nainital upheld (after intensive arguments) a reply to a RTI query made in the year 2007 that “an information pertaining to the year 1994 was more than twenty years old in the year 2007” (vide the Writ Petition No.726 of the year 2008) and such a whimsically arbitrary judgment could be given because the Hon’ble courts in India are not obliged to give reasons for their decision or judgment. If 'Public' were 'Interested' in probity, virtuousness, righteousness, patriotism, fairness, equality, etc, etc, WOULD THEY HAVE ALLOWED SUCH MPs/MLAs to be elected as elected for the past 60+ yrs? WOULD THEY HAVE ALLOWED VOTE BANK POLITICS TO SPLIT THEM INTO ST/SC/BC/OBC, Dalits, Muslims, Christians.....!!! Thus, we have MPs/MLAs who are responsible for Appointments, Transfers, Posting/Promotions across all govt dept and then what should we all experts commentators across this cool comfortable Internet forum expect?????????

      India is totally a corrupt country. CJI has proven allegation for favoring his family and recently passed judgement by dismissing Swamy plea for making Chidambaram accused in 2 G scam is again highlighting the fact that Judges make huge windfall in high profile cases killing the spirit of Judgement and judiciary.

      Till such time corruptsb like Balakrishnans are not punished corruption can not be checked. Such persons must be given exemplary punishment to send proper signal to persons holding high offices the probe and prosecution must be done under the supervision supreme court or someone named by the office of CJI and it must be time bound.Since there is prima facie a case against him he must be removed from the chairmanship of NHRC.

      KG Balakrishnan is one of the most corrupt chief justice independent India ever had. During his regime as CJI, lot of cases went in favour of Congress party. Thus, the govt. reciprocated and rewarded him making him head of NHRC. As long as the power lies in the hands of the govt. to appoint bureaucrats, this politician-bureaucrat nexus will always remain and will thrive. Every post should be scrutinized and candidates should be appointed only after getting a green signal from Judiciary, EC, Leader of Opposition and Leader of ruling party. A background check should be done by CBI under direct supervision of SC. Only then corrupt people like KG Balakrishnan can be prevented from occupying top posts and abuse it.

        A good observation. If there is a chance for the UPA2 Government to select the judge of its choice as CJI, the country would have not seen the impartial and able judge - Justice Mr. S.H.Kapadia as CJI. There are some benches in the Supreme Court which never passed an order that makes the Congress Party or UPA2 unhappy. Hence, Mr. S.M.Krishna has mentioned his matter before the Court Hall No. 2 to get the relief and as expected, he was releived temporarily.

      Indian courts have at least 40 percent of corrupt, criminals, rapists and anti-nationals. UP PF scam (22 judges from top to bottom) is one of the worst, where nothing has happened. Here the main witness was murdered in jail. That is the standard of Indian judicial system.
