New Delhi, Apr 16 (PTI) A group of teachers from the Jamia Milia Islamia has approached the National Commission for Minorities (NCM) to restrain the authorities from implementing reservation for OBC candidates, claiming that the issue of university's minority status is still pending before it. Appearing before the Commission advocate M Tarique Siddiqui, arguing for the teachers' association, contended that it was necessary to pass the order in view of the recent Supreme Court judgement giving a green signal for implementation of the 27 per cent OBC quota, which was not applicable to minority institutions.
The Association alleged that the OBC reservation was not applicable in the Jamia University which was a minority institution but the Vice-Chancellor had, earlier, proposed to provide the reservation by saying that it was not a minority institution. The Commission, however, refused to pass any order after the University counsel submitted that matter relating to University education did not come within the jurisdiction of NCM.
"We have to cross the first hurdle by deciding whether we have the jurisdiction to deal with the issue which has been pointed out by the University counsel. Only thereafter we would be able to hear you," the Commission said while posting the matter for further hearing on July 7.
The association in its petition alleged that contrary to the law, which says that OBC reservation was not applicable to minority institutions, the Vice-Chancellor had written to the University Grants Commission saying that the reservation policy was acceptable to the University. It also alleged that in the Delhi High Court, the University had taken a stand that it was a minority institution but for the sake of providing reservation it was changing its stand before the Commission.
The Commission had earlier directed the Vice-Chancellor of the University to make its stand clear on the issue of minority status of the University. PTI.
