    Life on hold while court dithered over divorce

    OCTOGENARIAN J. M. Kohli correctly anticipates the most obvious question related to his unique case - why divorce at 80?

    "We never thought of ourselves as each other's spouse We have been fighting from the beginning - she for money, I for separation," he said. From his marriage on June 20, 1953, till the Delhi High Court's final nod to his divorce from Kanta on January 13 this year, Kohli remembers having fought seven different court cases, three of which are still on in various courts, in the feud.

    Kohli first filed for divorce in 1982, and a trial court granted it, but Kanta filed a petition against the ruling in the high court, claiming she had not been heard. Kohli regrets that the best years of his life - the nearly 30 years since he filed for divorce - were spent in rushing from one court to another, hearing to hearing.

    And a lot has happened in between - an alleged attempt on his life, a brain haemorrhage, being abandoned by his family, untimely transfers to remote areas, unsubstantiated charges of corruption, obstacles to promotion and pension, lost parenthood and a missing marital life. What does a couple willing to part ways and start life afresh do when asked by the court to wait till it delivers its judgment?

    "A trial court takes four to five years to decide such matters, the high court, on the other hand, takes 10- 15 years, by when all plans to begin marital life anew fails. It is during this stressful time when a person feels the need for love and companionship of this necessity then," Kohli's counsel Geeta Luthra said.

    Kanta's counsel Rajat Navet also agreed that the case shouldn't have dragged on for so long. " We were just fighting the case to absolve my client of charges of cruelty to her husband. There was no other motive," he said. Kanta chose not to comment. Kohli said the years he spent in abandonment - when his first wife allegedly threw him out of the house he had built - were the most stressful.

    His frail frame quivering with anger, Kohli alleges that his wife took his money and the jewellery he had inherited and later accused him of demanding a dowry which she couldn't prove, besides the charge of his alleged corruption.

    "Kanta's brother was a senior bureaucrat and made my life miserable. He kept me moving to remote areas like the Andaman and Nicobar Islands," Kohli said. But Kohli's connection with courts, it seems, is here to stay. " I have to go to a court in Saket on the 20th, the next day I'll be at the Delhi High Court for another case and on February 18, I have to be at the Tis Hazari courts," he said.

      Its hard even for law to decide for such cases, but yes women have been given to much importance, which they misuse. All those allegation are already mentioned in the books of laws all they have to do is to make a statement and fight begins.
      Mr. kholi.I know its not just you have lost those golden times but most important is you have lost those feelings.Even if you want them you can not make yourself up to those feelings. Too many questions (especially "why?"), insecurity, distrust, indecisiveness, confusion.i know what you have gone through, and now being victorious, you still lost it.
      I am 32 now and going through something like this. will i be yet another Mr. kholi? what future hold for me? "i don't know". what i am losing the most? " normal parenting for my kids".
      Divorce sucks.
      now you have already learnt too much, what i can suggest you. All i can say "chill out".

      In our country marrying is easy. Getting out of marriage is such a long drawn process if only one of the spouses is willing to get away and start afresh. In general girls/ladies without decent monthly income apprehend that once divorced they are not going to get another good/decent propsal from another man. They think they are sunk/ruined. Hence they retort to vengeance type of feelings and try to ruin the life of their ex-hubby by taking shelter under our foolish leagal system. Unless a pro-citizen governance is kept in place, we as a country need to suffer like this.

      This is very sad to learn that it took a lifetime for a man to get an answer from court....
      Yet i would say wat did he get after getting a divorce at the age of 80.... yes he might have been feeling free & happy with his victory. but i would like to ask him was it worth it???? The fight, ego & hatred for someone was more important than his life. rather than wasting their precious years fighting in the court, if the couple might would have acted maturely, keeping aside their interfering folks & would have tried to talk it out, sorted out the things. May be their life would have been different today......
      People go for divorce to give themselves another chance. but guys watch out.... its ur life.... it is ur state of mind that ll matter & its ur decision that can make a difference. Not the lawyers & judges sitting in the courts. Not ur folks who might be giving u unnecessary confusing opinions. Its just u & only YOU who ll be bearing the maximum brunt of the thing..... so always act according to the need of the time.
      Never ever get carried away by people's comments (even ur own folks) about ur spouse. every one who gets married, marries with stars in their eyes, with the hope of living happily ever after & with the belief ," yes, this is the one for me & i will share my heart with this him/ her"
      why cant we understand believe in our own statements & beliefs.....

      P.S.- i am no one to judge this man but still i think wasting almost entire life on a fight, is not worth it.... life is too sort to love, try not to waste it hating....

      Hi

      First i Want to say that please stop abusing our Indian legal systems .

      beacause it is made by us not anyone strange entity called as God or something else . I am disappointed as well as feeling sorry for Mr. Kohli's unbearable pain of life . the worst thing here is that maybe he achieved so called justice today but this justice has become meaningless for him .
      Shameful . Because no one can give him back his precious life again . it hurt like hell . maybe today or tomorrow legal system is going to be get stronger against evil .

      but you what is the real route cause behind this :- we let it to happen . we are the only spectator. it is also quite real that so many so called good responsible persons were aware of this fact that Mr. Kohli is right & having troubles . but why didn't they took any initiative .

      In this world we have to face & fight worst people who is doing wrong to Society . they can be a Men or Women .

      But we don't have to give up our hope help each other . please don't appreciate Injustice by making idiotic phrases .

      Happening good dies when good person are going to keep silence . wake up .

      I hope our outdated Indian Judiciary get a little internet savvy and read these articles. Shame on these judges who treat their jobs in a typical government fashion and don't carry their posts dignifyingly. Dont your families, children feel disgusted about you for working like one clerk in the Judiciary. Why should every government activity including the so called judiciary also be slow. Judges wake up and act now. I have seen the court rooms and their attitudes OMG! unbelievable.

      Such a sad and painful story, all sympathy to Mr Kohli, lets wish him his Independence day, we can realise life at 80 and he has spend the best years of his life in courts. Shame on our Indian Judicial system who favours women regardlessly, hope they wake up sooner than later and can save others lives from being wasted.

      Your comments only indicate how far away you stand in complete darkness to our ancient Indian teachings. Now just read the following:-

      Well friends I do have limitations in translation from Sanskrit to English. However,interpretation in short is something like this :-

      1. For love one's heart should be without any wrong / ill will (Vidvesha) and the love should be like love between a cow & its calf. (selfless like - without expectations).

      2. Son should work as per directions of father & mother ie he should be worthy & obedient to his parents. Husband should be protective - loving & wife should be Madhumati ( should be sweetly speaking - loving to husband). Family would be peaceful & happy.

      From the above it will be seen that responsibilities have been laid down for every one. Here only two Mantra have been shown (with constraints in translation) as it is not possible to explain in detail. Pl obtain a copy of "ATHERVEDA" with translation to get in to details. ATHERVEDA contains more than 5000 Mantra.

      Mr. Kohi must have gone throught a hell, whereas his wife must be enjoying fruits of court delaying. This is denial of justice. All those who were debating on TV channels about wife-beating by a Govt babu in London forget how the middle and upper class ladies are making use of law to their advantage. Laws (IPR 498A, etc) and courts are more favourable to these ball-cutty ladies than to women from poor, uneducated and villagers. When will this change?

      Hey man,as a saying goes:'marriage has many pains but celibacy(divorced-life) has no gain'. Lived quite many years together...But what a pity to fail to convey the right(God's) message of marriage(2 the younger generations), "loving one's spouse as oneself til the end of his/her life's journey,despite of every life's battle"! Think about it. It's not the court that has instituted the marriage, it's your Creator God who made it for u. all the best.

      Kudos to Mr Kohli!..Life is not just about money, society, pride, prejudice(whatever that means!), success or failure. What Mr Kohli has shown is NEVER SAY DIE. I am one amongst the thousands of Indians who is going through this nightmare called divorce. I say nightmare, not because it is about lack of companionship, but due to the never ending,lengthy and complicated path our outdated legal system involves us with! I am not advocating nor discouraging divorce here. Divorce is about what you feel deep within yourself...about righteousness,about wanting to be judged on a level playing field. Its about living with some dignity, self respect and a feeling of being useful. Its about your conscious which reminds you that you have ceased to live a life like a human being and its high time you wake up and reassert yourself. There is always a misconception that men who divorce are always guilty of breaking the marriage for their own gains and women are the innocent sufferers. While it may still hold true for some percentage of cases, it is always equally worth noting that times have changed and there are a lot of men there who suffer female agression and arrogance. Some like me choose to call it quits after honest, conscious efforts to set right the problem...and there are hordes of people out there who are suffering in silence in the fear that they might never be heard...or for the simple reason that the might be labelled a failure!
      Mr Kohlis story is truly an inspiring one for all those men out there who suffer in silence...Just listen to your heart guys...and dont be afraid to do the right thing when you are convinced that you are the innocent victim! Cheers to a new begining..

      i must say you have tried for so long for separation if you would have taken half time and half effort to settle down things in your life you would have saved your life and time.......its drastic to hear this.....and i am feeling regret for life
      there is no big issues in life with life partner whcich cannot be sorted by simple disscussion...after all she married you not for divorce...people are commenting by reading addvertisement/news no body bothered about other story of mam....

      my personal experience - i say this. the educated weaker sex enjoys the full advantage of present situation. Our Judicial system's working proves that 'JUSTICE DELAYED IS JUSTICE DENIED'. This is a burning example of our judiciary systems' tortoise pace.I support through my this message in favour of Mr. Kohli which shows the way majority of husbands are being tortured by the wives for no fault of theirs. An understanding woman only can make a home for which such culture should have transpired from the parents, otherwise in the present situation, when the women are fighting for equal status with men, more such divorce can be witnessed in the years to come and we are fast approaching to have western culture where marriage is not considered to be inevitable.

This needs to be stopped ,,, it high time. If two people don't want to stay together why the hell courts have problem in that ,, entire law is made to give business to the lawyers.
