    New Delhi, Feb 12 (IANS) India ranks prominently high in the list of countries plagued by corruption, a Delhi court has said while handing down one year imprisonment to two convicts in a 24-year-old graft and forgery case.

    Observing that the anti-corruption measures in India were perceived by people to be ineffective, Central Bureau of Investigation Special Judge V.K. Maheshwari said that corruption was a scourge that not only affected progress and development in society but also posed a grave challenge to governance.

    "Unfortunately, India ranks prominently high in the list of countries plagued by corruption. Anti-Corruption measures in India are perceived by the people to be weak and ineffective," the court said.

    "The United Nations Global Report on Crime and Justice quotes public opinion surveys in a number of countries, to point out that citizenry in those countries ranks corruption as one among the five most important problems facing their society," the court said Thursday, in a verdict that has just become available.

    The judge said people's doubts over the ability of the criminal justice administration to deal with the corrupt led to public cynicism and distrust in almost all government institutions.

    The court awarded one year rigorous imprisonment to O.P. Dabas and A.K. Puri for helping a Tihar Jail inmate get shifted to a state-owned hospital and avail nursing home facilities in 1988. The court also imposed a fine of Rs.60.000 each on the convicts.

    Dabas and Puri helped Gurbux Biryani, arrested in a drugs case, to shift from jail to Lok Nayak Jai Prakash Narayan (LNJP) Hospital and then to the adjoining G.B. Pant Hospital and avail special nursing home facilities on two occasions July 28, 1988 and Aug 5, 1988. Biryani died Jan 25, 2010 during trial.

    Dabas was working as reception assistant in G.B. Pant Hospital and Puri was the brother-in-law of Biryani.

    The court held both of them guilty under the provisions of the Prevention of Corruption Act, criminal conspiracy and forgery.

    The court acquitted Jolly Bansal, a doctor, and Sushil Kumar, an LNJP hospital employee.

    "Ashok Puri in connivance and conspiracy with Dabas had got Gurbux Biryani illegally admitted to LNJP Hospital and managed false and forged admission summary/transfer summary on the basis of which in furtherance of his criminal conspiracy along with O.P. Dabas got Biryani admitted to G.B. Pant Hospital on July 28, 1988 and Aug 5, 1988," the court said.

    CBI prosecutor Brajesh Shukla examined 55 witnesses in the case.

      It was Rajeev Gandhi who once said only 15p reaches at the bottom for every one rupee spent by the government. But he did nothing to stop the corrupt system that swallows the rest He also once stated corruption is at the bottom and not at the upper layer of the administration. He, thus contradicted his own obsesrvation.Nehru during the last days of his reign wondered why this affluency at the top and poverty at the botton in the socialistic pattern of our society. He also did nothing to stop the flow of money into the wallets of the rich. All other PMs were frantically trying to protect their position and did nothing to stop the growing trend of corruption All third class people come in politics and teach others the lessons of morals and righteousness. The tragedsy is good men do not come forward. Even anti corruption movement was taken vigouraously by Anna , a retired Truck Driver from Army assisted by some disgruntled govt officers like Bedi, Kejriwal and the Bhushans who favour their clients-criminal or non criminal-professionally. Anti corruption movement turned into a fight for passing Lokpal Bill the provisions of which come to pictire only after the criminal act. The movement failed and Anna &co is no more on the national scene.All political parties from 1972 perhaps with the exception of 177 election, came to power by contesting election on money power and with the backing of all anti social elements who could keep the people under their spell tainted with corrupt practice. Our spiritual gurus are not far behind. They run institutions with the support and concessions obtained from the govt in power.
      In fact people are corrupt. In this situation ,it is clear that our functioning under this constistuion has miserably failed. In my opinion we need a nationl goverment at the centre run by the best men of integrity( people like Seshan) and similar govts at state level for another ten years. They with their wisdom may enact laws to confiscate all illgotten wealth from corrupt men and punish them . Declare emergency if found necessary. Send the hard core to gallows and display their corpse in public places with placards showing their criminal act.
      You may say it is a stupid proposal of an idiot. You are correct. But it is better than the method by which our superior men deal with corruption. Keeping 80% people below poverty line and 20% enjoying all the comforts and gains for the sake of democracy is not acceptable .The present gathering of storm against corruption is a warning that a bloody revolution is in the making and the youth are no more ready to accept the homlies of our corrupt politicians. A drastic action is needed before it is too late.

        We do not have a modicum of people who maintain probity and integrity. It is not the responsibility of the govt. to teach morality to the people. It is the responsibility of the parents and the community based on religious faith or philosophy to which they belong. Our religious system is eroded and our majority of Gurus and Acharyas indulge in conspicuous indulgence in comfort and pleasure. pareants teach their children the ways and means to loot the neighbours and spend crores to get lucrative jobs for them. Politics is one among them for all the wooden headed duds,dunces,dullards and dastards. Many make their children doctors and engineers to murder the innocents.
        Remedy lies in bringing up children by the parents with the support of govt and religious or philosophical preaches to impart and instill moral lessons to the coming generation. If we work today changes can be brought about within 25 to 50 years. If you are in a hurry to get justice talibenise the nation and resort to the remedy given above.

      The honourable judge is telling us something we all know and against which Anna was fighting.
      Unfortunately, the congress achieved its aim in derailing the agitation by making frivolous charges against his core group.
      We are seeing the results in the state elections in UP where all the parties have put up candidates with criminal records. Where criminals rule the nation, can one expect honesty in the government.
      What is the judiciary doing. They are just attacking the surface, leaving the rotten roots to continue their work.
      We are seeing the site of an impotent election commissioner, appealing the the President of India to rein in the minister Salman Kurshed.
      The President then forwards the complaint to another impotent person, the prime minister to look into the complaint, knowing full well that he will not take any action as they are both from the same party - the congress.
      Oh! how I wish Mr. T N Seshan was here.
      He would have straightened these recalcitrant politicians.

        I like to correct your belief. Anna's fight is not to stop corruption. As per his advisers, corruption would go but only in the end, you prosecute the responsible ones, if caught. There is no clear understanding of the causes of corruption, or how to prevent it. Simply by bringing PM (on whom there are no allegations) in the purview of Lok Pal, he thinks that the officials will become clean. BJP that opposes Lok Ayukta in Karnataka claims support to Lok Pal in the centre. I doubt his movement is sponsored by corrupt industrialists who want to divert people's attention from them.

        I agree with SRC and as well Sudhir. Lokpal bill is supposed to instil scare in the minds of politicians and Govt servants of being prosecuted, if caught. But the bill alone doesn't stop corruption as long as one doesn't get caught. It is true that everyone has to raise their ethical standards and practice honesty and restrain. But higher ethical standards and honesty cannot be practiced by a nation unless each citizen does that first. Ethics and values is something that is bottom up (taught in each home by parents and teachers at school) and is never effective when imposed top downby the State. Very rarely people become unethical and corrupt due to Govt's procedures and practices. They are themselves unethical and corrupt and thus practice corruption while working for the Govt. These rotten eggs spoil the atmosphere and work culture and also are successful in converting the meek individuals into rotten eggs like them. This way corruption becomes rampant.

        Today in India corruption has reached such heights that we find very few who are honest and ethical.

      Our Dearest Anna Hazare tried his best to put a a working anti corruption bill Jan Lik Pal Bill, but he was defeated bad by the stand taken by the Government. He had fallen ill during his fasting strike and no body knows what is happening about his movement. May God Bless him !!!       once when I was waiting in singapore air port , the interview with their president was telecasted. One of the trade union worker asked him how are you controlling corruption ? President os singapore replied " I control corruption from top not from bottom. So If anything wrong occurs due to corruption , the concerned miister is asked to resign. So my ministres are always in tension. Thus corrruption is controlled" Why not India follw such a good system?

      its not onlythe politicians responsible alone judiciary too responsible in spoiling the nation.why after24 years such a judgement, had courts been active in hanging corrupt perhaps country would have not got such bad comments from others.when apex courts judges were alleged to be corrupt what if a petty govt official gone corrupt.howmany judges have gone into jails, i remember how a honest judge wa s humiliated when he tried to ,punish his clerk,if through enquiries are made into judges conductand their hench advocates , clear picture will emerge where and who is most corrupt in system.have seen people who were nothing now multi millionaire jsut coz of hanky panky in courts system.no justice for poor, if courts start enquiring implementation of their orders in delhi itself , fact will tell the holes in system, if a poor man dies in an factory , no compensation evenafter years of litigationand ownergets relief,even judges behave rudely with poor people.behave like dictatorsn goondas.of ourse everyone is not corrupt but because of handful people we feeling ashamed.

      Radheshyam - Well said. It is like asking a dog to do the work and the dog in turn asking its tail to do. In the end none will do the work neither the person who orders nor the dog or its tail. India judicial system is a laughing stock for the entire world. If you ask me neither Dabas nor Puri have done any henious crimes like our politicians. Dabas has used his power to help a sick person and Puri his money to work it out. They have not done any crime looting or killing, etc. All they made was a small mistake of shifting a sick person from jail to hospital for treatment. Most of our politicians find excuses like this and go abroad or desi hospitals despite being healthy. For CBI this is a great crime and it has taken 14 years to investigate these silly things. No wonder why there are thousands and thousands of more serious cases (mainly political cases) that are lying untouched or getting swept under the carpet. Madam Maheshwari is telling what even a toddler knows.

      Indian politicians are basically the most greedy, corrupt, vindictive, selfish, and dishonest people who don't hesitate to commit any crime, be it murder, rape, stealing and siphoning Govt funds, accepting bribes and do nothing, indulging in all kinds of corrupt practices, and finally not being bothered at all about India's image at the international level. If anyone raises his voice against such unscrupulous people, they get instantly stamped, harrassed, and victimized.

      Given the current corrupt political culture and the bad blood all around in our country, we need a bloody revolution like the French Revolution or leave it to God to end the Kaliyug. We all witnessed how Anna Hazare's peaceful agitation got stamped and killed by such dishonest and corrupt people running our country. Today most of the Indians are hasstled due to this rampant corruption, unfairness, criminalization of the society at large. It is clear that no human beings can change India ever. We just have to wait for God's intervention to end this Kaliyug and restart life in this world including India.

      Are the officials of the finance ministry and the tax officials vigilant ? do they work on the information and tipoff ? does the official in the ministry take the tip-off seriously ? are the informers and people who provide tip – off properly rewarded ? does the tax official encourage the informer to give more tip-offs and more information ? ?
      are officials properly using the information and tipoff on tax evader and black money ?
      the finance minister and other top official themselves will check if the officials in the department are vigilant and give due importance to an information from an informer . does the department official checks the complaints and emails properly ? do the officials take the mails they receive , seriously ?
      the finance ministry is struggling to meet its revenue target . at such a crucial juncture the role of informers giving tips on tax – evader and tax-evasion is going to be extremely helpful .
      hence the finance department bosses have decided to send information to the officials to check whether the official acts seriously on the piece of information . the boss will “ plant ” some information posing as general public to see whether the officials are vigilant enough or sleeps over valuable information .
      the top bosses have been told to pose as informers and send information on tax-evaders to the officials . the boss will then monitor whether the official acts or sits over the information . if an official is found not acting on information then the official will be viewed as being negligent towards duty ( revenue generation ) .
      the finance ministry bosses thinks that some of the information may not be correct and may cause undue harassment to some people , yet all the tipoff has to be taken seriously when revenue collection is struggling .
      so it is time the department officials shrug – off the lax attitude and try to look seriously at complain received on tax evasion .
      who knows next time when a finance department official receives a lead through a sms or mail , it may have been sent deliberately by the finance minister ( pranab mukherjee ) himself . the bosses may send these “test” s m s , to check the response of the junior and how fast the junior official acts .
