    Fresh setback for Modi, probe ordered into more fake shootouts

    New Delhi, Jan 25 (IANS) In yet another setback to Gujarat Chief Minister Narendra Modi, the Supreme Court Wednesday directed a panel headed by former apex court judge M.B. Shah to probe 15 cases of alleged staged shootout killings in the state 2003-06.

    An apex court bench of Justice Aftab Alam and Justice C.K. Prasad said that it was open to the monitoring authority headed by Justice (retd) Shah to constitute its own investigating team of police officers either from the existing special task force (STF) or other officers from within and outside the state.

    The court said the monitoring authority would steer clear of the cases that were already under investigation on the direction of the apex court or the Gujarat High Court. This included the staged shootout cases of alleged gangster Sohrabuddin Sheikh and alleged terrorist Ishrat Jahan and three others.

    The apex court is already hearing a Central Bureau of Investigation (CBI) plea seeking investigation into alleged staged shootout killing of Tulsiram Prajapati, an aide of Sohrabuddin Sheikh, saying his case was part of a chain.

    The court said that the monitoring authority had "ample powers to guide and instruct the STF on the mode, manner and direction in regards to the investigation in the encounter killings".

    The court requested Justice (retd) Shah that all cases of alleged stage shootouts be thoroughly investigated so that "truth in each case is revealed".

    The Gujarat government Aug 2, 2011, constituted the STF to investigate these killings and by another order set up a monitoring authority headed by Justice (retd) Shah to monitor the investigation by the STF.

    The order said that the monitoring authority could "call for earlier case records in respect of encounter deaths and the records of the NHRC (National Human Rights Commission)".

    The court said that it was desirable that in the first instance the monitoring authority may be asked to have these cases investigated so that the "truth in each case is revealed".

    The court said that the two writ petitions by lyricist Javed Akhtar and social activist Shabnam Hashmi and journalist B.G. Varghese be placed before Justice (retd) Shah.

    Justice (retd) Shah, if so desired, may afford an opportunity to the victims, their kith and kin to appear before the authority to submit their cases, the court said.

    As the court was passing its order, counsel Prashant Bhushan, sought a probe into the alleged cover-up attempts by police after the alleged staged shootouts.

    Going through the terms of reference of the order which set up the STF and the monitoring authority, the court observed that "on paper it looks good". "If you put it into practice, it will go a long way in upholding the rule of law," the judges said.

    As Bhushan sought additional direction to the monitoring authority to consider any request for compensation, Additional Advocate General of Gujarat Tushar Mehta said that it was already there in the terms of scope of the authority.

    The court said that the monitoring authority would submit its first report on the progress of the investigation into the staged shootout cases within three months.

    Akhtar and Hashmi had sought a probe by a special investigation team into the alleged staged shootout killing of Sameer Khan in October 2002. Varghese sought investigation into the alleged staged shootout killing of 21 people, as admitted by the state government in assembly.

      Though it is clear to one & every one that Narendra Modi is at least partly (if not in totality) to be blamed for not able to protect its citizen both Godhra & post Godhra which was his RAJHDHARMA. But these has happened many times throughout India per & post Independence 1984 Sikh Riots, Ethnic Cleansing of Kashmiri Pundits, Religious involvement in NORTH-EAST INDIA Militancy, Anti Muslim Violence such as Hasimpura Massacres (1987), Bombay Riots (1983), Bhagalpur Riots (1989), Gujarat Riots (2002) Aligarh Riots (2006) to name a few. It seems that just before during elections most of these allegation crops up which make truly secular & apolitical citizen like us think about timing if not the purpose of these issue raised by different forum. Mr. DIGVIJAY SINGH kindly note that the foolish & utterly nonsense speeches meant for particular (illiterate) part of society may boomerang if the true purpose of yours intentionally rubbish statement is understood by them with will happen in very near future as it happened with Mr. Lalu Prasad Yadav. A (different) Mr. Nitesh Kumar may take up the stage & make your Wish of ruling a DAY DREAM. We all citizen are behind the progress that is happening under C.M.       Press always credits Gujrat news to Modi when it is negative. They are biased since the posives-and they are plenty- are never given the front pages it so richly deserves. If the court has given this ruling,so be it. What is a setback for Modi here?? He will come clean as God is with him.       Every citizen of this country should ponder over what is happening in regard to upholding of Rule of Law. The impression one gets is that Gujarat is the only problematic State. What is happening to various States which are involved in fake encounters. Is there anyone bothered or concerned about upholding the rule of law in those states. In Gujarat the allegation is that Sohrabuddin was a ganster but in many states innocent are being killed in the name of encounter. I wish somebody opens their eyes and ears and do something about it.

        In the early eighties under the direction of Indira Gandhi and the ruling congress thousands of Sikh youths were dragged out of their houses all across Punjab by the CRP forces and ere tortured and then shot in fake encounters.
        In 1984 so called Delhi riots, Sikhs all across India were killed and burnt alive by Congress Party thugs under the watchful eye of then Prime minister Rajiv Gandhi. Most of the congress leaders who led the mobs are ministers in present day congress government in Delhi.
        India is the land with a law of a jungle. The State terrorism is there from the sixties.Will it happen again. It sure will unless Indians unite and stop acting like slaves.

      Narendra Modi is under constant fear of being ‘exposed’ of his murky role in 2002 Gujarat riots. In order to avoid being exposed, for him it was necessary to remain in power so that he can destroy and manipulate evidences and influence investigations. The riots had cause polarisation of the electoral on communal lines and the advantage had gone to Modi in the elections which were held almost immediately after the riots. Being head of the state, he misused his power and destroyed evidences and records which could lead to his indictments, directly or indirectly. He constantly lauded and awarded his administration, especially the police, so that it worked ‘for’ him. Greed for pat and reward coupled with the ‘generosity’ of the Modi government, provided the police with the ‘licence to kill’ the innocents. This worked in Modi’s favour a great deal as it helped him silence voices against him and polarise society on communal line. Most of the so called encounters were simply cold blooded murders carried out by the state police. Modi as a CM never took any interest in punishing the culprits, instead, his government was always found to be defending, justifying and often rewarding the killers.

      During the last ten years Modi did real good job by steering his state into industrial development for which he must be complemented. But this cannot exonerate Modi from his misdeeds. It was the same ‘fear’ that compelled Modi to do this good work. This good work of his will definitely gather him some good public support. Such supports are crucial for him for remaining into power.

      It was not the corruption but the fear of being ‘exposed’ that he (his government) resisted and even challenged installation of Lokayukta in the state. SC recent order of investigation into all the encounters is massive setback for Modi but it will be disastrous for him if the findings point finger at him. Modi, amid all these, would definitely like to have the state assembly elections held as early as possible.
