    Chidambaram verdict: Who said what

New Delhi, Feb 4 (IANS) A special CBI court in Delhi Saturday dismissed Janata Party chief Subramanian Swamy's plea to make P. Chidambaram a co-accused in the 2G spectrum allocation case, spelling huge relief for the home minister.

Here are the key quotes -

Judge O.P. Saini: "There is no material on record to suggest that Mr. Chidambaram was acting with such corrupt or illegal motives or was in abuse of his official position, while consenting to the two decisions. There is no evidence that he obtained any pecuniary advantage without any public interest."

Finance Minister Pranab Mukherjee: "It is a good judgment and it is a relief because unnecessarily somebody was persecuted."

Telecom Minister Kapil Sibal: "The truth can never be hidden. The fact is Chidambaram, who is a valued colleague, we knew all along that he was not responsible in any way either directly or indirectly and that these allegations were being made for political motives. He (Swamy) can appeal in the high court, in the Supreme Court and then in the end, he can appeal to god."

Janata Party chief Subramanian Swamy: "I think this order deserves to be reversed, therefore I will go to the high court, and then from the high court to the Supreme Court. Both Chidambaram and (former telecom minister A.) Raja together made the decisions."

BJP spokesperson Ravi Shankar Prasad: "This is the order of the very first court. There are other hierarchy of courts also. As far as political accountability of Chidambaram in view of overwhelming evidence there in public domain, the BJP shall continue to insist for that accountability - inside and outside the parliament."

Communist Party of India-Marxist leader Nilotpal Basu: "The final word in the matter has not been said. The prime minister must explain to the people why there was a (2G) policy failure."

Trinamool Congress MP Sukhendu Shekar Roy: "We don't want to comment on the judgment because the matter is still sub judice and the petitioner has the option of approaching the higher court. The picture of the whole case is still not clear. But the way the court has cancelled 122 telecom licences, it shows that something was seriously wrong in the their distribution. We want the guilty to be identified and prosecuted. The guilty should be punished irrespective of political colour."

Is there anybody who can ask the concerned authorities to investigate in to the contract given to son of Mr Chidambarm for putting up sign boards of various banks with changed logos, viz.Canara Banks and State Banks boards? Or may be other parties are scared that their kith and kin were also awarded similar contracts so that both the parties can keep quiet and pat each others back? Afyter all our Bharat is Mahan, though almost all leaders are BEIMAAN to the core.

Friends, There is always "a lull before the storm". A storm is in the offing, and not too far. OP.Saini seems to be different person from what he is projected outside. Like a cop acting tough posturing, in reality he is for bribery ! Time will tell.
      • Gyan 3 months ago
Let all criminals and theirs sons and daughters have a great fun with this judgement! OP Saini was a constable before becoming judge. Even Rs 10 bribery is too much for his stature!

No body should take serious and offensive if a KG child says some thing but must heed an advice from an experienced professor ! This kg studying constable turned lawyer judge has yet to study more law to upgrade for Apex court, or probably awaiting a quick promotion from the tainted govt. and its HM! It is a shame that some corrupt lawers are appointed judges, but it is a greater shame for Govt. to recommend them and it is the greatest shame for any president to appoint such corrupt judges without personally verifying the nature and past history of such lawres before being appointed judges.Iwll take on all scoundrels after final judgement by the Apex court in time to come! All corrupts will suffer at the hands of GOD ! I appeal this as requested by Kapil Sibalo ! these sinners would suffer cancers and Aids and still more new
      maladies to come yet!

Like Jesus said, they do not know what they (the congress men) are doing. They crime without knowing that they crime and they comment without knowing what they comment. That is why Tytler was not punished though he burnt the sikhs in the public. Chidambaram might have just shacked his head. How can shacking head become a crime to be proved in a court of law?. In short; Congress man - no punishment. We pay tax up to 30% and get nothing. We should also be considering the loots as another tax payable by us and keep voting. Otherwise we cannot sleep and if we go to the court, those criminals also cannot sleep. Why this Kola vari

pm not responsible, Finminister not responsible for a fraud of Rs.176 lakh crore? What then is a cabinet for if not for preventing such a fraud? I t is simply not feasible for Ab Raja to have done it single handedly? This judgement is intended for the upcoming elections as it is sure to be overruled by superior courts as it overlooks the criminal negligence of the PM, FM and other cabinet members in not doing what they should have done. As expected CBI courts/ judges are also going the CBI way, a good enough reason for the Supreme court to closely monitor the case

Yes! He should be responsible for the mis
deeds of his team. The apex Court has proved that the deeds were wrong.

I was involved in a civil case in the Andhra Pradesh High court once, and my opponent bought the high court judge with just a few lakhs.
Imagine what would a Supreme court judge not do if he is given 100 crores which may be not even 1 percent of the thousands of crores stolen by Raja as the front man and the congress mafia behind him.

      ACADEMIC & JUDICIAL CORRUPTIONS
An old saying that a country/institution which does not give justice to its people or which does not regard its learned ones, gets ruined sooner or later. A very strong corruption control law is most needed in whimsical judiciary and academics as documented herein. IITs NOT BEING WORLD CLASS INSTITUTIONS because it is well on record that IIT Roorkee’s once famous Civil Engineering Department had about a dozen full fledged professors who could never earn a Ph.D. degree or publish any significant research papers despite their best efforts and fullest administrative backing and this fact was well known to the Ministry of Education (now MHRD) who never viewed this truth with any kindness. On top of this, the academic administration of this IIT (the oldest former technical Higher Learning University of India/Asia), backed also by such non-PhD jealous virus professors, sabotaged (including plagiarizing) the research work of the highly internationally renowned professor colleague through all kinds of possible illegal actions manifested by as many as 20 to 30 writ petitions filed to nullify the illegal actions repeatedly taken without any regard of natural justice. These are well recorded facts also known to the MHRD. If an institutional index (integrated effect of the various Institutional components including the credentials of the faculty) or teacher/faculty index (integrated effect of the research potential, teaching ability, qualifications, etc of every faculty member) for all IITs are worked out and compared with world class Institutions, then the truth will come out. Merit is totally disregarded in the Indian system as manifested by the fact that India is branded as a developing third world country despite the fact that it has the highest manpower of highly qualified hard working genius persons in almost all disciplines in the entire world or on world basis. Thus the smaller but merit minded countries defeat us in cricket, diplomacy etc. Numerous examples will show that the merited ones in India will find their habitat only in the dust-bins. If India can rise above caste, region, and relative considerations and sincerely rely on merit then alone the IITs would become world class Institutions. A research paper entitled “A NEW METHOD OF EVALUATING TECHNOLOGICAL RESEARCH TEACHERS’ by Prof. Devendra S. Bhargava, published in the International Journal for Development Technology, England, Vol.5, 1987 pp.27-38, contents of which were comprehensively highlighted by the PTI news flash, can be of great help to compare the various IITs, their faculty, and their nearness to the world class. An Institution’s three main pillars, viz. the faculty, the students and the reputation are interdependent. This is proved by the fact that now the best students do not opt for Roorkee IIT which was in news for vulgar activities too. This Institution also manipulated to pass a twice failed student apart from allowing students to pressurize their teacher to give 90% marks sometime back. A recent case example manifests glorifies and testifies this aspect when the Hon’ble UttraKhand High Court at Nainital upheld (after intensive arguments) a reply to a RTI query made in the year 2007 that “an information pertaining to the year 1994 was more than twenty years old in the year 2007” (vide the Writ Petition No.726 of the year 2008) and such a whimsically arbitrary judgment could be given because the Hon’ble courts in India are not obliged to give reasons for their decision or judgment.

Sure there was no material evidence that he received any pecuniary advantage. The Prime Minister s on record on so called ' coalition compulsions' - what does this imply? What was the loot sharing agreements with coalition partners especially since many held the ATM ministries ? Who was the Congress Party's points person to manage the division of the loot?

By absolving Manmohan Singh, the PM of the day of any wrong-doing in the 2G scam the Apex Court of the country gave sufficient hint to poor Saini to give a similar judgement in case of Chidambaram, the HM of the day. This is India, my dear!!!!

If the verdict in trial court were to be in favour of Mr Swamy, the congress and the government would have cried foul, and also they would have declared going for further appeal in the High Court/Supreme Court. Now it is good that Mr Swamy has the chance to go to High Court and then to Supreme Court and establish the truth. I, along with many many other well wishers, wish him all the best and wish he would settle the matter once and for ever. But the behaviour of the ruling party and its leaders is appalling, to say the least.

It is pity that the learned judge does not know the fact the whole nation know. The judgement is great disservice to our motherland.. It has murdered the truth.

It is proved that Sibal does not know much about laws. So he is talking of God! Pronob Mukriji, a joker in the bandit block, does not understand anything! As Saini had to read judgment written in 10, Janpath, he could not see much truth. No wonder India is fifth most corrupt in Asia. There are still some sane judges/justices instead of Sonia chamcha judges/justices. Let us see who can understand laws!

Mr Raja is small fish. He can not this decison on his own. Congress is somewher is connected. Congress leaders are very much clever. By sending raja and d/o of karunanidhi to jail congress can control KArunanidhi. Why karunanidhi is so silent. He should defend Raja.
Media should ask to Karunanidhi various question I am sure he will say something.

Mr.Saini's judgement is questionable. How can one man be in jail and the other man remains as a Minister for the same role of act. This verdict creates fear in the minds of people like me as to how the case will affect morale of the country. Mr.Saini accepts the role of participation of
Chidambaram in deciding the price with A.Raja, but asks the material evidence for criminality and pecuniary benefit. 122 licences sanctioned by Shri A.Raja and Chidambaram have been cancelled. Do you need any more evidence than this. If Raja is guilty so is Chidambaram. MILLS OF GOD GRIND SLOW but SURE. .Mr.Shamless Sibal will also realise it in near future. JAI HIND.

Chid. had full knowledge of scam as per the records which he was supposed to check . He allowed it to happen which is itself a criminal offence even if he did not participate in it.How and why should Court ignore this ?
